Cristy Fermin Acquitted in Cyberlibel Case Filed by Dominic Roque

MANILA, Philippines — Veteran showbiz columnist and broadcaster Cristy Fermin has been acquitted of cyberlibel charges filed by actor Dominic Roque, marking a significant legal victory for the media personality in a string of high-profile cases.

The decision was handed down by the Makati City Regional Trial Court, which ruled that the prosecution failed to provide sufficient evidence to prove the elements of libel beyond reasonable doubt. The case stemmed from comments made by Fermin on her digital program, “Showbiz Now Na!” and her radio show, “Cristy Ferminute,” where she discussed the actor’s lifestyle and a high-end condominium unit.

Core of the Ruling:

  • Lack of Malice: The court found that Fermin’s remarks were within the bounds of “fair comment” on public figures. In Philippine law, libel requires proof of “actual malice”—the knowledge that a statement was false or made with reckless disregard for the truth.
  • Public Interest: The court noted that because Roque is a celebrity, discussions regarding his life and career are matters of public interest, providing journalists and commentators a wider latitude for expression.
  • Insufficient Evidence: Legal counsel for Fermin emphasized that the vlogger was simply reporting on rumors already circulating in the showbiz industry rather than inventing defamatory claims.

In a statement following the acquittal, Fermin expressed relief and reiterated that her work is not intended to destroy reputations but to provide commentary on the entertainment industry. “I have always stood by the truth and my responsibility as a journalist. This victory is not just for me, but for the freedom of the press,” she said.

Dominic Roque, who filed the complaint in early 2024 following his highly publicized breakup with actress Bea Alonzo, has yet to issue a formal statement regarding the court’s decision. This case was one of several legal battles Fermin faced recently, including similar complaints from other high-profile celebrities.
