
The Sandiganbayan has denied Senator Jinggoy Estrada’s appeal to dismiss 11 counts of graft related to the alleged misuse of ₱183 million in pork barrel funds, also known as the Priority Development Assistance Fund (PDAF).
In a 99-page resolution, the anti-graft court cited strong evidence presented by prosecution witnesses and whistleblowers—including Benhur Luy and former Janet Napoles employees—detailing how Estrada’s PDAF was funneled to fake NGOs managed by Napoles. These NGOs reportedly implemented non-existent projects while diverting funds as kickbacks to Estrada and associates.
The ruling highlighted support from the Commission on Audit’s (COA) 2012 special audit, which exposed irregularities, including lack of public bidding, fake suppliers, unregistered or dubious NGO addresses, and unauthorized fund disbursements—all allegedly done at Estrada’s behest.
The court also validated Luy’s testimony and financial records (Daily Disbursement Reports and Summary of Rebates), which showed Estrada allegedly received at least ₱183.7 million in kickbacks. Estrada’s claim that these records were unreliable printouts was dismissed, as the National Bureau of Investigation confirmed their authenticity.
The court concluded that Estrada’s PDAF was “systematically pocketed” and that no benefits reached the intended project beneficiaries.
As a result, Estrada’s demurrer to evidence and motion to dismiss were denied.
In a statement, Estrada expressed disappointment but vowed to continue his legal fight, maintaining faith in the justice system and asserting his innocence. He also pledged to fulfill his senatorial duties throughout the ongoing case.
